Trademark Renewal Services

Trademark renewal is a critical process that involves re-registering a trademark to extend its legal protection. It ensures that the rights to a unique brand, symbol, or logo remain exclusively with the original owner, preventing unauthorized use by others. Renewing a trademark typically occurs every 10 years, maintaining its validity and the associated legal benefits. The process can involve filing specific forms, such as the TM-R in India, and may include options to renew as-is or with alterations. Timely renewal is essential to avoid lapses in protection, which can lead to legal complications and potential loss of brand identity.

Why Trademark Renewal Matters ?

Continued Legal Protection
Brand Identity Preservation
Avoiding Trademark Cancellation
Market Position and Value
Enforcement Against Infringement
Global Business Opportunities
Continued Legal Protection

Renewing your trademark ensures continued legal protection, preventing others from using similar marks that could confuse customers or dilute your brand.

Brand Identity Preservation

Trademarks are vital for brand recognition and reputation. Renewal helps maintain the unique identity and goodwill associated with your brand.

Avoiding Trademark Cancellation

If a trademark is not renewed, it can be canceled, leaving your brand vulnerable to infringement and losing its exclusive rights.

Market Position & Value

A valid trademark contributes to the overall value and competitive position of your business in the market.

Enforcement Against Infringement

With an active trademark, you have the legal backing to take action against any unauthorized use of your brand or similar marks.

Global Business Opportunities

For businesses operating internationally or planning to expand, a renewed trademark ensures protection in different markets and facilitates global branding strategies.

Procedure for Trademark Renewal

Renewing your trademark is essential to keep it protected and secure. Whether you want to keep it as it is or make some changes, we’ve got you covered. Here’s a straightforward breakdown of the process:

Form TM-R: The application for renewal is made through Form TM-R, which can be filed either for renewal without change or with changes in the sign or the particulars of the trademark.

Online or Offline Submission: The TM-R form can be submitted online through the official Intellectual Property India website or offline at one of the Trademark Registrar Offices.

Authorized Agent: The trademark owner or an authorized agent (such as a trademark attorney) can file the renewal application

Renewal Fee: A prescribed fee is required at the time of filing the renewal application. This fee may vary based on whether the application is filed online or offline.

Registrar’s Review: The Trademark Registrar will examine the application to ensure compliance with the legal requirements.

Public Notification: If accepted, the renewal details are published in the Trademark Journal. This is a public notification allowing any objections to be raised by third parties.

Objection Handling: In case of objections, appropriate responses must be filed. This may involve legal proceedings to address any opposition.

Certificate Issuance: Once the application is approved and no objections are received (or objections are successfully resolved), a renewal certificate is issued. This confirms the continuation of trademark protection for another 10 years.

Post-Registration Compliances Monitoring & Enforcing Trademark Rights Trademark Usage & Maintance Record Keeping & Updating Registration Details

Monitoring & Enforcing Trademark Rights

Regular Monitoring: Regularly monitor the market to ensure that no unauthorized parties are using your trademark. This includes keeping an eye on new trademark applications to prevent registrations of similar marks.

Legal Action: Be prepared to take legal action against infringements or unauthorized use of your trademark. This is crucial to maintain the exclusive rights granted by the trademark.

Trademark Usage and Maintenance

Consistent Use: Use the trademark consistently in the manner in which it was registered. Any significant deviation in the use can lead to weakening of the trademark rights or even cancellation on grounds of non-use.

Quality Control: Maintain the quality of goods or services associated with the trademark. The reputation and value of a trademark are directly linked to the quality it represents.

Record Keeping & Updating Registration Details

Documentation: Keep detailed records of the trademark usage, renewal certificates, and any legal documents related to the trademark. These records are crucial in case of any legal disputes or official inquiries.

Updating Registration Details: Promptly update any changes in ownership, address, or other relevant details in the trademark registration. This ensures that all correspondences and legal notices are properly received and managed.

Required Documents for DSC Application Submission

What is a Digital signature?

A digital signature is an electronic form of a signature that can be used to authenticate the identity of the sender of a message or the signer of a document and also ensure that the original content of the message or document that has been sent is unchanged. Digital signatures are easily transportable and cannot be imitated by someone else. The ability to ensure that the original signed message arrived means that the sender cannot easily disclaim it later.

Should an individual's signature and encryption certificate be different?

Yes, the signature and encryption certificate should be separate for an individual. The encryption keys are to be generated at the subscriber's system and should be archived before transfer into crypto-medium. The signature keys should be generated in the crypto-medium and not copied.

Does one require multiple certificates for different applications?

No, Ideally, there should not be any requirement for different certificates. However, the person holding a lower assurance Class 2 certificate may require higher assurance Class 3 certificates for application which demand the same. The higher assurance Class 3 certificates can be used wherever application requires a lower assurance certificate. Apart from assurance, additional certification may be required depending on the information included in the DSC (For example, PAN Number may be needed for the application).

Where can I use Digital Signature Certificate?

You can use Digital Signature Certificates for the following:

⦁ For sending and receiving digitally signed and encrypted emails.
⦁ For carrying out secure web-based transactions or identifying other participants of web-based transactions.
⦁ In e-Tendering, eProcurement, MCA [For Registrar of Companies efiling], Income Tax [For efiling income tax returns] Applications, and many other applications.
⦁ For signing documents like MSWord, MS Excel, and PDFs.
⦁ It plays a pivotal role in creating a paperless office.
⦁ All subscribers who use Digital Certificates for Income Tax, MCA (ROC), Tenders, Foreign Trade, Banking, Railways, and many other needs.

Whether Documents Signer Certificate can be treated as Organisational Certificate

The document signer certificate is issued for use with an organization's software for an automated authenticated response. A document signer certificate is not a replacement for the signature of the authorized signatory of the organization.

What is PKI?d as Organisational Certificate

A public key infrastructure (PKI) supports the distribution, verification, and revocation of public keys used for public-key encryption and enables linking identities with public-key certificates.

A PKI enables users and systems to securely exchange data over the Internet and verify the legitimacy of certificate-holding entities, such as webservers, other authenticated servers, and individuals. The PKI enables users to authenticate digital certificate holders and mediate the process of certificate revocation using cryptographic algorithms to secure the process.

What is the difference between a Digital Signature and a Digital Signature Certificate?

A digital signature is an electronic method of signing an electronic document, whereas a Digital Signature Certificate is a computer-based record that

⦁ Identifies the Certifying Authority issuing it.
⦁ Has the name and other details that can identify the subscriber.
⦁ Contains the subscriber's public key.
⦁ It is digitally signed by the Certifying Authority issuing it.
⦁ It is valid for either one year or two years.
